september 24th, 2010. captioning funded by cbs the weekend is upon us. good friday morning to all of you. i'm maggie rodriguez. >> i'm harry smith. >> let's get right to the dangerous flooding. heavy rains left many areas covered in several feet of water and more rain in the forecast today. holly wagner of minneapolis station wcco-tv brings us up to date from owatonna minnesota. >> reporter: here in southern minnesota, the intense early autumn rain triggered flooding that flooded homes, the water kept rising through the night and the rain isn't over yet. the high water forced hundreds of people to leave their homes. floodwaters overwhelmed the town of owatonna where residents

battled the rising water through the day. >> enough. enough rain. >> reporter: over ten inches of rain fell in some areas yesterday. and it's not just the damage to buildings and roadways. valuable farm labd is being swamped, as well. >> it's higher than we have seen it back in the early '60s so we're -- one record unchartered territory right now. >> reporter: the governors of minnesota and wisconsin declared emergencies for large parts of the state. in wisconsin, the small town of arcardia got the worst of it where the national guard has been called in. nearly 350 homes there were evacuated as three-foot waves of floodwater surged through the city. back in minnesota, residents worked through the day and into the night but for some it was a losing battle. >> feel really helpless watching the water come up in the basement and nothing to do. you just watch it rise. >> reporter: the red cross opened a shelter here in southern minnesota. somewhat drier weather is forecast for today and another

storm system is expected on saturday. maggie? >> holly wagner in minnesota, thank you. we'll get the extended forecast in a moment from dave. first here's harry. >> all right maggie. one of the biggest issues in congress right now, those bush-era tax cuts expire next year not decided until after election day. democratic leaders made the decision as sarah palin announced a challenge to a key group of democrats in congress. cbs news congressional correspondent nancy cordes is in washington with the latest. good morning. >> reporter: harry, good morning. sarah palin positioned herself at the nexus between the republican party and the tea party working aggressively to get candidates elected from both camps and did intensity of the election season is having real impact on law making here in washington. in what was shaping up to be the biggest battle of the fall senate democrats backed down and decided to put off a showdown over bush-era tax cuts until after the all-important november elections. some democrats think that with

the campaign out of the way, it would be easier to reach a compromise with the gop. republicans may be less willing to compromise if sarah palin's latest attack on vulnerable democrats succeeds. it comes in the form of a new website called take back the 20. alaska's former governor raising money, targeting 20 house democrats for defeat. they're all from conservative districts. and voted for the health care bill. >> if republicans turn out and conservatives turn out in these districts then the republicans may have a good chance to recapture those house seats. >> reporter: if they do palin will be able to claim partial credit. elevating her stature in a party lacking a clear leader with two years to go before the presidential election. in a new interview on fox news palin sent the strongest signal yet she's open to running for president. >> a reason to run is if nobody else were to step up with the solutions that are needed to get

the economy back on the right track. i would offer myself up in the name of service to the public but i also know that anybody, anybody can make a huge difference in this country without a title, without an office. just being out there as an advocate for solutions that can work to get the country on the right track. >> reporter: now that the campaign season is in full swing, palin is using facebook to take swipes at the current administration almost daily. lies, damned lies. obama care six months later she tweeted to 260,000 followers last night. she doles advice on twitter, as well telling delaware's christine o'donnell to shun the national media. o'donnell said she is right. stopped doing the national interviews and when palin speaks, they listen harry. >> nancy cordes in washington this morning, thank you very much. joining us now conservative author ann coulter and strategist maria cardona. good morning. >> good morning. >> good morning. >> ann, let me start with you.

this whole i went on the website this morning with the 20 different congressional seats that she's trying to target. the sort of -- the pledge to america which sounded like a response to the tea party and to sarah palin yesterday. is she the defact to head of the republican party right now? >> she's very powerful. i mean the same way we kept being asked is rush limbaugh the head. she has that sort of influence right now and which is why i always find it kind of strange when people ask if she'll run for president. i liked what she said there. it's a threat to republican presidential candidates, you you better be saying the right things or maybe i will get in but to give up what she has now and run for president would be like rush giving it up an running for president. she has more influence than a president does. >> is that really the truth? is what that was yesterday in the interview, listen to me listen to who we are and if you embrace our orthodoxy you'll

have a chance otherwise i'll put my foot through the door? >> well, i haven't spoken to her but i kind of took it that way. just you know, no more john mccains. no more bob doles. >> let me -- i want to switch this over to maria. just looking at this from an outside perspective, the republicans, the tea party, sarah palin, they're the ones with the momentum. think tier ones with the enthusiasm. if you're a democrat trying to run in this atmosphere what do you say, what do you do where do you go for a message? >> i think what you have to do is draw a clear contrast between what you would be offering as a democrat, especially to working class families and middle class families and what the republicans would be offering if they were to take over in november. and frankly, the pledge to america makes it very clear that they would be going back to the same regurgitated and importantly failed economic policies that were in place before 2006 when they were in

power. john boehner said it himself. we'll be no different than we have been. >> they did a giant focus group online basically and said what do you want us to be about? that's what they wrote in this pledge. by and large seems to me it is about less government and less taxes. isn't that -- seems to me this atmosphere, this recession that doesn't go away even though it's officially over that's something to run on. >> giggling about that in the makeup room. the recession's over. yay! >> let's have a party. >> it's -- >> of course that's the republican philosophy and, yes, smaller government lower taxes. there's more to it. i mean in some ways it is the contract with america. it has some -- such simple points that you can't believe this isn't already the case. the contract with america, for example, had congress has to live under the laws it passes itself. this new pledge has congress gets three days to read a new bill. you have to cite the constitutional provision before passing a law.

these are common sense proposals. >> maria, let me ask you this. is the president of the united states, is president obama an asset or a liability to democrats running this fall? >> well i think overall he's a hoonlg asset. but clearly, the democrats have to focus on their own districts and when's going on in their own campaigns. but again, i think that it would behoove democrats to make that distinction between what the democrats would be offering or going to continue to offer in terms of the change that everybody voted for and everybody's frustration is that change didn't come fast enough. republicans in power seeing from this pledge of america they would put the insurance industry back in power, wall street back in power. and frankly, middle class families and working class families would once again to the back bunner while they focus on the tax cuts for multimillionaires and billionaires and cost us $700 billion in the future. >> americans have six weeks to

figure it out. maria, ann thank you very much for being here this morning. >> thank you so much. for more than a year we have been following the story of three american hikers arrested along the iraq-iran border. last week one of them sarah are shourd, was freed from prison in iran and since then calling for the release of the others, her fiancee shane bauer and friend josh fattal. after speaking her with her mom several times over the past year it is my absolute pleasure to welcome sarah herself. good morning. >> good morning. >> wonderful to have you here with us. >> good to be here. >> i saw you on sunday freed and looking at you today i get the same impression. there's not a look of joy, of celebration yet in your face. >> no. this is not what i thought it would be. you know, i thought this would be the end and at this point i don't know when the end is going to come so now i'm in a position of the families of anxiety and uncertainty and really no guarantees. of course, we have hope but we don't know when this is going to

hope. >> hope that shane and josh will be released. have you had any word about how they're doing? >> no. as soon as i left the prison walls behind me there's absolutely no communication. and i have no way of knowing if they're okay or what's going on with them. you know if there's been changes in the conditions now that i'm not there any longer. >> can you tell us what your days were like? you spent most of the time 23 hours a day in solitary confinement. >> yeah. it's true. josh and shane were my lifeline. the day was spent anticipateing the time with them. >> how much time? >> nothing for the first almost three months and then half an hour. slowly increased with begging and pleading and, you know a lot of tears. but i would, you know anticipate and center my whole day around that time. my only human contact. so when the hour drew near and i never knew exactly when i would be taken out but i would

start pacing around the room and wringing my hands and just often just crying full of anxiety, when i saw them compassionate, supportive young men. we would sit in a circle and hold hands and, you know every time i felt like i was slipping away, they would bring me mack. >> you would see them for an hour a day. the rest of the time you were in a room by yourself. how big of a room? >> about maybe five feet by ten. >> and that's where you had your meals? >> yeah. everything. >> everything? were they kind to you were the guards kind? >> it's a mixed bag. some are really compassionate. it is a difficult job to have to watch people suffering. the rest of the world, you know prisoners are practically invisible. their pain is invisible. we can't see shane and josh right now even though they're cramped in a little cell. their cell is the same as mine and two of them so with the beds taking up half the room they exercise side by side on a space

the size of a towel and they have no idea when to get out. they have committed no crime. they don't deserve to be there. and so i want to make their pain more visible. my pain was invisible and the guards slammed the door and walk away. no matter how much i cried and or at times i screamed. you know? >> are you hopeful that they will be with you? that your fiancee shane that proposed with you in prison will be soon? >> of course i'm hopeful. you know, hope is what sustains you and we know this is going to end. there's too many people and governments around the world that want this to end. and i believe there can be you know a resolution that both sides are satisfied with. i believe it's better for everyone to end this. >> we wish you well. we'll stay with it until it's over. thank you so much sarah shourd. nice to meet you. >> you, too. time for a check of the news with jeff glor at the news desk.

good morning. >> good morning, everyone. three members of the international space station crew including an american woman supposed to be back on earth this morning. instead, they're stuck in orbit. thanks to bulky clamps holding up the reentry spacecraft. we get the latest from cbs news space consultant bill harwood in orlando, florida. bill, do flight controllers know exactly what's wrong and h to fix it and in any way danger this morning? >> reporter: well i'm not sure about what it takes to fix it. when they last left this and they went to bed, unresolved and not clear what the problem was. this is an extremely reliable system using it for decades. these hooks that hold the soyuz capsule in place to release to let it go didn't happen and they have to fix that. as to whether they're in danger or not no. they were perfectly safe inside the capsule but the issue is they have six people on board. two of the capsules and if there's an emergency for a quick evacuation, right now until this is resolved three of those crew

elizabeth wenger. there's a new possibility on good morning. it's 7:25. time for news headlines from cbs 5. i'm elizabeth wenger. there is a new possibility on what caused the pipeline explosion in san bruno. the "chronicle" reports bacteria inside of the pipe may have weak ends it similar to an explosion 10 years ago in new mexico. in san bruno today, work will continue to clear burned homes to make way for reconstruction. there is a chance california will have a new budget soon. the governor's office reports some progress in this week's talks with legislative leaders. they plan to work on details over the weekend and meet again. a federal judge is expected to rule today on whether california can resume executions at san quentin. the judge blocked state deaths by lethal injection back in 2006 because of the pain it caused. well, now the state has a new death chamber and new

procedure aimed at addressing that problem. traffic and weather right after this.

point of view. elmo will be here celebrating the 41st season of "sesame street" starting on monday. there are far too many videos on the internet showing girls fighting each other but this is an especially ugly one in florida causing police to lock up a parent. jeff glor is here with the story. good morning. >> good morning again to you. a local sheriff says a local mother watched and encouraged the daughter's fight and now facing criminal charges. captured on video, the disturbing fight in palmetto florida. >> get her, sarah. >> reporter: two 16-year-olds apparently fighting over a boy. >> attack her! throw it! throw it! >> reporter: it's a scene most parents would cringe at a cheering crowd encourage the girls to beat each other. trying to get this [ bleep ] on youtube. >> reporter: one voice was not a

schoolmate but a mother. the woman in the white shirt is one of the girl's moms and police say she's guilty of a crime. >> basically in shock a parent can sit there and watch their child or any child involved in a situation like this and not intervene. pretty obvious that this is child abuse. >> reporter: the manatee county sheriff's office charged 39-year-old april newcomb with third-degree child abuse for encouraging the girls to fight. she acknowledged she was, quote, wrong and i understand where you all are coming from. i think, unfortunately, it was going to happen no matter what. it seems that she knew about the fight before it even began. there she is walking with her daughter to confront the other girl. the fight lasted about three minutes. it convicted newcomb could face up to five years in prison. newcomb posted a $15,000 bail and was released from jail. police do say that nobody was seriously hurt in that fight. maggie?

>> jeff, thank you very much. psychologist dr. jeff gardere joins us now. good morning, jeff. >> good morning, maggie. >> this woman faces five years in prison. in your view was her behavior criminal? >> it was criminal, atrocious. it was absolutely stupid and i think she realizes what she did was wrong. good parents does not dictate you egg your child on. you work with your child and teach them conflict resolution skills and i have to point out she was afraid that her daughter might get hurt in the back of the head because she had a previous head injury and as we can see, she's hit with rapid punches in the back of the head several times and this is horrific. >> not only caught up in the moment, we see her walking with her daughter to the fight and appears she knew about it beforehand and didn't try to stop it. where's the parenting here? >> seems like a lot of people knew about it. you can see they're soshded by folks, you know they posted this thing on youtube, of course.

the parenting was nonexistent here and i think we have seen this before where parents are caught up living vicariously through the children and i guess she wants her daughter to win because in her own way she is helping her daughter with her self esteem and absolutely the wrong thing. she wants herself to win saying she has a champion on her hands but it is again, atrocious. >> another mom shows up and doesn't stop it either. so why is this happening? i mean it is not just lone mother that was clueless but at least two in this case. >> absolutely. as well as other people surrounding them. we're seeing more of the girls gone wild sorts of situations. as women have gotten more rights, equal

>> good morning, harry. >> goes back to court today. what will happen? >> we're in the sure. the judge hasn't said yet. she could walk in and say, you know what? i'm pleading not guilty to this. there's another circumstance involved and in case they probably set it down for a hearing date. >> call witnesses to prove it? >> she could walk in and say as she said on the twitter feed look made a mistake. we breached the requirements here and it could be handled right an away today. there's no issue. what will i do as the judge? >> sure. >> a couple of possibilities. >> is the choice going back -- i mean, a myriad of choices. >> right. >> but among them going back to rehab or going to jail? >> you know what? when you have a violation of probation, the judge has a vast opportunity in terms of what he or she is going to do here. we know that the judge warned her saying if you come back bring your toothbrush. you are going for 30 days. the judge doesn't have to send her for 30 days. >> their 30 days isn't really 30

days. it is a day or two days. >> if i'm a lawyer i might say, we have set up our own rehab schedule and going to a hard-core place where she is going to be there for 30 45 days, whatever it takes. let's do that. that's a better resolution of this than dropping her in jail for 30 days but as you said even if he says 30 days questions is the integrity of the justice system. if 30 days is 5 days who's it helping? not helping the system. >> on the other hand among the heinous crimes committed out there, all of this time all of this court time being consumed by -- >> it's a -- you have to have respect for the justice system and for sentences but as you said, is this a murder? clearly not. something to be dealt with in some fashion? obviously. >> another issue is a deal to make a movie. if you're representing her and you can stand there in front of the judge saying look this is -- one of the things we know that will help her along the way is getting her employment and

if you promise the rehab or whatever else would a judge listen to that an argument like that? >> could be a big problem. i had a client say to me, i don't want to be on probation. let me do the jail time. i won't do well on probation. i'll sign off for 30, 60, 90 days without somebody looking over my shoulder. it would not be a good thing but professionally needing to get out to do a film maybe in november, it may well be she might say -- i have no information, let me do the time. get out and work through the process myself. >> would you think she is going to be in the clinker tonight? >> i don't know about that. i don't think she's going to go home ultimately. some place else but i don't think it's home. >> jack ford thanks so much. >> all right, harry. facebook founder zuckerberg friends new jersey with $100 million donation. we'll have that story when we come back. when we

school. this, despite spending nearly $20,000 per pupil, the highest in the state. zuk kerberg, who attended harvard university and is the subject of the soon-to-be-released film "the social network" is not the first billionaire to earmark private funds for failing schools. last year, bill and melinda gates promised $90 million to the memphis school district and another $100 million to help students in tampa zuk kerberg is working with newark's democratic mayor, a rising star in new jersey politics who zuk kerberg is now counting on to turn around the state's largest school district. >> he's going to have to be bold and he's going to have to be innovative and really bring the newark school system up to par. >> reporter: initial plans for the money include merit pay for teachers and expansion of charter schools.

it is 7:55. time for news headlines from cbs 5. i'm sydnie kohara. there will be a funeral today for the 15-year-old novato high school student who was killed in a suspected drunk driving crash. he was one of three teenagers in a car last friday when it hit a tractor-trailer. the 16-year-old driver now faces manslaughter and felony dui charges. there is a chance california will have a new budget soon. the governor's office reporting some progress in this week's talks with the legislative leaders. they plan to work on details over the weekend and meet again monday. and uc-berkeley is cutting more staff. the university will get rid of 200 jobs next year. that will save about $20 million. cal won't say, though, which jobs are on the chopping block. but a consultancy firm told

good morning, everyone. a flooding emergency in the midwest this morning. flash flooding forced hundreds in southern minnesota and wisconsin to leave their homes. polly wagner of our station wcco is in owatonna this morning. good morning. >> reporter: good morning, jeff. both governors of wisconsin and here in minnesota declared emergencies in large parts of the state. we are here in southern minnesota where folks spent all day yesterday and a good portion of the night battling the rising water. everybody >> everybody is pulling together. it's helped for everybody. whoever needs help gets help. >> reporter: the heavy rain from the fast-moving water that knocked out roadways and inundated homes. floodwaters overwhelmed the town of owatonna. >> the last couple of hours, it keeps rising. it's not stopping. >> reporter: more than ten inches of rain fell in some areas yesterday. the high water damaged roads, homes and valuable farmland. in wisconsin, the small town of

>> when i started using pills, i was 15. i just took them and fell in love. >> everyone is high school does it. it's like a thing to do in high school. >> i had thoughts of robbing a pharmacy. >> by all appear answers they are unlikely drug addicts, from loving homes, in well to do neighborhoods. these kids are among the more than 3 million teens who admit to having abused prescription drugs. many like megan, get their fix from the family medicine cabinet where she found oxycontin, an opiate prescribed for pain, one of the most abused drugs in america. >> my mom had surgery. she had them in the cabinet. she didn't notice. two weeks later i was taking them 24/7. >> how easy is it to get prescription drugs. >> some kids find a way to get ahold of the prescription like the paper from the doctors. we go to several differ doctors and get a couple bottles.

>> how much would you use? how often would you use it? >> every day. >> every day. >> every day. oxycontin, klonopin. >> you could be a pharmacist. >> probably. >> although these kids try to hide it their addictions were identified and they are currently receiving treatment. >> somewhere along the way you've got to figure out how it is you're going to stay clean when you get out of here. >> how did your parents not know you were high. >> i would make up excuses. if i started to vomit because i was too high. i would be like i'm sick. i ate something bad. >> they believed you. >> i think my mom kind of wanted to believe me. >> prescription drugs. why do you think that's growing in popularity? >> easier access. it's almost like a safer way to get it. you don't have to go to the corner. >> that sense of security has led to an epidemic. >> the abuse of pharmaceutical drugs is up around 9% over just last year. the teens who abuse prescription

drugs for nonmedical purposes, they did it before the age of 15. >> in an effort to reduce pill abuse and theft, the u.s. drug enforcement administration will hold its first nationwide prescription drug takeback tomorrow. people can safely dispose of unwanted medication at more than 3,000 sites around the country. >> there are parents out there that say not my kid. no way. >> i would say don't blow it off. they are everywhere. >> it can happen to anyone. there's no person or kid out there that has a bubble around them saying they will never do drugs. >> reporter: michelle miller cbs news, new york. here to talk more about this is early show contributor dr. jennifer hartstein she's a child and adolescent psychologist. >> good morning. >> 400% increase in the last 10 years. why do you think it's been so dramatic? >> it's an incredibly huge increase. i think there's ease of use. >> easy access like the girl

said. >> it's in your house, your medicine cabinet. you don't have to seek it out. you can hide it more. the signs aren't there, so the parents can know what you're doing. >> what's also scary, kids are younger and younger. kids as young as 12 years old doing that. >> 12 and older. >> if your kid smokes you can smell the smoke. if your kid drinks you can see they are drunk. if they abuse prescription drugs, how can you tell? >> it's harder. talking about feeling hot, maybe they are nauseous eyes are red, nose running, lethargic, trouble in school. some of the signs are the same. it's much harder to look for. you have to look in your cabinets and see what's going on. >> not just cabinets. aren't there other hot spots. >> medicine cabinet. kitchen, households appliances. garages, they are using inhalants in the garage. you want to look any place there's some sort of chemical you can look there. >> you can talk to your kids about drug abuse. what can you do besides this to

prevent this. >> mrs. three things. the first, monitor. know what's in your house. know what's in your cabinet. do an inventory. the second thing is secure it. you want to really know lock it up keep it protected. the last thing you want to do throw it away. dispose of the things you're not using. get rid of it. that action tomorrow is about. >> they will dispose of them. >> right. >> i think this next tip will be particularly helpful to parents. you may not realize it but your child may be using drugs using code words. >> we have to think about what that is. one thing they talk about a lot, farming. going and looking through. chill pills or tranqs big boys. cough medicine is thing, too. they may use tussin or skittles. that's using cough medicine to get high.

record it. >> and i read that you used to sing gospel music with elvis when you two were on tour in vegas subpoena that true? >> yes. >> what songs did you sing and was he surprised were you a gospel man? >> he was surprised i knew so many songs. i was at caesar's pal igs and ellis and he would bring his musicians upstairs and we would sing gospel songs. elvis loved gauss pelle music more than anything else. soap i used to join in on some. the ones i knew i would. one of the songs on the album we did is called "run on." when elvis was singing it, i would jump in. so -- >> it's so good. >> he said you should record that, and i said i will one day. >> luckily for us tom jones has recorded gospel and here to sing exclusively "green green grass of home" once again, tom jones. thank you, tom. >> thank you.

we have been talking a lot about "sesame street" this week thanks to this video of elmo with katy perry. it was supposed to be part of this ground-breaking program's 41st season which starts on monday. but it was pulled after a controversy erupted over what perry was wearing. we had a big conversation about this yesterday. elmo is here with us this morning. along with "sesame street's" executive producer carol lynn paernt to talk to us about this controversy. how are you this morning? >> we're good right, elmo. >> wonderful. >> yeah, wonderful first things first, making the video with

headlines... th ce california will it is 8:55. good morning, everyone. i'm sydnie kohara with your cbs 5 news headlines. keep your fingers crossed, there is a chance california will have a new budget soon. the governor's office reports some progress in talks with legislative leaders. they plan to work on details over the weekend and then meet again monday. the state has been without a budget for nearly three months. a federal judge expected to rule today on whether california can resume execution at san quentin. the judge blocked state defendants lethal injection in 2006 because of the pain. but now the state has a new death chamber and procedure to address the problem. juan uribe hits two home runs in one inning to help the san francisco giants get back into first place in the national league west. the giants beating the cubs in

chicago 13-0. and then san diego lost to los angeles, which gives the giants a half game lead over the padres. traffic and weather right after this.
